Hi,

I`ve been following the developments in Broadway Market, regarding the buy-up of several shops and the unrightful eviction of many of the tenants there. I`ve been trying to gather information about the current state of things, but with no luck.`m especially interested in hearing about what has happened about Spirit`s situation at the Nutritious Food Gallery, and if he still is in limbo with the Council/Dr. Wratten, or if things have changed for better or worse.

I would really appreciate any information/news anyeone might be in possession of,

Hi,

I stopped going to meetings a few months ago, but the case of Spirit is still a "live" one.

There a is still the urgent need for raising funds.

Actually, it doesn't look very good - their lawyers have all angles covered and are determined to kick him out.

This is piece from a couple of months ago:

Over the past few months there have been various discussions with Hackney Council, both its Officers
and Councillors in seeking to resolve outstanding issues from the property sales fiasco.

I am currently in contact with them regarding the recommendations put forward by the Governance &
resources Scrutiny Committee Panel Review to recover the 14 units in Dalston Lane which are currently owned
by the same Bahamas based Company which owns Spirit’s shop in Broadway Market. Those discussions are
on-going.

But with regard to Spirit (71 Broadway Market) and Tony (34 Broadway Market) there has been no movement
on the part of Hackney Council, although they acknowledge that the situation requires sorting out.

As many of you will know, Spirit won his appeal on 12th April 2006, although he still owed some £ 25,000
in rent arrears. His Landlords have now appealed against the decision of the Court. They will need to
get permission to Appeal and a decision on this is expected within the next 7 days or so, although it is
quite likely that they will get permission.

They are appealing the decision which, effectively, identified Spirit as an Assured Residential Tenant as
they consider that decision to be unfair and flawed. They are also appealing against the decision not to
award costs against Spirit. Even so, they have also issued Notice of Seeking Possession of Spirit’s shop and home on the grounds that he is an Assured Tenant with more than 2 months rent outstanding. So they have covered all angles.

This was an ideal opportunity for Hackney Council to intervene and to try to resolve the situation. I put
this to them and they now advise only that they ‘will await the decision of the Court of Appeal before
proceeding further’.

I would invite all supporters to write to Hackney Council or to e:mail them (see below) to protest at
their inaction in dealing with the cases of Spirit and Tony and calling upon them to take immediate action to
acknowledge past failings and to end the distress which this on-going situation is causing to both
Spirit and Tony.

FUNDRAISING

We also need help fundraising. If you have any good
ideas for helping raise the money to meet Spirit's
arrears over the next few months, please get in touch.
We have put on parties and reggae nights, but there
are lots of other ways to raise money - eg
exhibitions, shows, auctions and raffles, gigs,
parties. Let us know if you can help out.

the campaign. Thanks to everyone for their support so

CURRENT LEGAL SITUATION

After Spirit’s appeal victory in April his landlords,
Broadway Investments Ltd. have been seeking permission
to appeal against this ruling. Their application is
currently being assessed by the courts and we hope it
will be turned down, effectively closing the case.

HACKNEY COUNCIL

Since Spirit’s appeal victory Hackney Council have
been repeatedly requested by us to make a clear
statement of intention regarding Spirit. Hackney
Council’s position at this point in time is that they
will not get involved in Spirit’s case until we have
confirmation that Broadway Investment’s application to
appeal has been denied, or until the appeal has been
heard.

WHAT NEXT?

We are waiting to see the outcome of Broadway
Investments application to appeal. If they are turned
down or lose the appeal we will be immediately
pursuing Hackney Council to resolve the situation. The
real weapon we have is the implicit acknowledgement by
Judge Cotran that Spirit is currently an assured
tenant – this means he would have been a secure tenant
at the time of the sale of the property and Councils
are not allowed to sell buildings with secure tenants
UNLESS the majority of tenants are in favour of the
sale. Clearly this was not the case!

If Hackney don’t sort things out Spirit would sue them
on this basis, leaving them open to lawsuits from
Broadway Investments as well...

We need to hang on in and get this appeal business out
of the way – this can only be a matter of a couple of
months now. Unfortunately Spirit can still be kicked
out of his shop and home by Broadway Investments with
immediate effect as soon as he falls behind on the
monthly arrears
payments.
