Premises belong to those who use and maintain them. The capitalist concept of property as an instrument of speculation is anathema to our philosophy.
The Local Federation of the CNT-AIT Madrid* is facing eviction from its historic premises – premises which its unions purchased, which it paid for and maintained. The Spanish union of CIT has used a sneaky manouevre to present itself as the owner of the premises by registering a ghost union to convince the courts that it is actually the owner – a fraud which the State is apparently eager to turn a blind eye to in its attempt to weaken the anarcho-syndicalist CNT-AIT, in favor of a more compliant alternative.
Like many of the premises that were acquired by CNT-AIT unions, the work and cost of getting them was carried out by the local unions. These were not purchased by the national organization and, in the case of the premises in Tirso de Molina, the Local Federation of Madrid only later received a loan. From the CNT-AIT. This is important because it comprised the largest part of the CNT-AIT for years, thus, the money used was also money which largely came from their own dues. Not from an outside source, not from an organization called CNT-CIT.
Despite these facts, the CIT union refused numerous times to make an agreement about these facts, insisting that any property which ever was owned by any union being federated in the CNT-AIT has become property of the CNT-CIT. And this is clearly not the case. Not only by anarchist principles, but even by bourgeois property laws, under normal circumstances. Unfortunately, the corporate raiders of the CIT unions will manipulate facts and use any small oversight to take over the premises of the CNT-AIT unions.
The following is a statement of the Local Federation of the CNT-AIT Madrid. We have added a few explanatory notes, as not everybody may understand a few details. CHAPTER 1. WHO BOUGHT AND PAID FOR THE PREMISES?
INTRODUCTION
At the beginning of this summer, we reported on the eviction ruling issued against the Madrid Local Federation (FL) of the CNT-AIT. We were ordered to voluntarily vacate the premises at Tirso de Molina 5, 2nd floor left, and 6th floor right, within one month. These premises, as we explain in this chapter, were first rented and then purchased in the name of two unions of the FL Madrid. The purchase was made by agreement of the FL Madrid , that is, of all the unions in the town. At all times, the Madrid Local Federation as a whole was responsible for paying the premises' expenses (loans, mortgages, taxes, community fees and assessments, water and electricity supplies, and liability insurance). Until six years ago, the Permanent Secretariat of the CNT CIT, through an administrative maneuver, took over our premises and prevented us from continuing to cover their expenses.
We must clarify that this ruling does not imply an immediate eviction. There are legal deadlines that must be met, and at this time we cannot specify when the eviction by police forces will take place. It could happen this fall, or perhaps it will be delayed until later. The ruling is not final, and naturally, we will appeal it.
Below, we'll tell you in detail everything related to our premises and how we've reached this inexplicable and immoral situation, in which we will likely be evicted from our premises by the State's repressive forces, despite having paid for, maintained, occupied, and maintained them for decades.
TIMELINE
1977 – The Various Trades Union of the Local Federation of Madrid (CNT AIT) informs the other unions of this Federation that it has found some available premises for rent in the Plaza de Tirso de Molina and proposes to share the rent with them. Finally, the contract is formalized in the name of the Madrid Construction Union (6th floor from the right) and the Madrid Metal Union (2nd floor from the left).**
** (It should be understood that these unions were named on the leases but in fact, responsibility and use of the premises always belonged to the Local Federation, the de-facto owners even if on the contracts there were names of some of its constituent unions.)
1988 – The Madrid Local Federation purchases both premises, which until then had been rented. Since the unions holding the rental contracts had priority in the purchase, the premises are placed in the names of those unions (Construction and Metal).
The premises are purchased with two bank loans for a total of 17,000,000 pesetas (equivalent to approximately 102,000 euros). This purchase is made with the approval of the Local Federation meeting in plenary session. The CNT does not intervene in any way. ***

1994 – December. The CNT-AIT grants a loan to the Madrid-based Federation for the settlement of its mortgage, for the outstanding amount of €90,000. By that date, the Local Federation had already paid off more than 10% of the mortgage.
1994 – The Local Federation begins repaying this loan.
2001-2007 – The Technical Building Inspection detects serious damage to the building, and as a result, the Neighborhood Association of Tirso de Molina, 5 is required to carry out structural work on the entire building. For the Local Federation of Madrid, this work resulted in total cost of 50,238.11 euros on the second floor and 47,393.93 euros on the sixth.
To cover these expenses, several requests for loan extensions to the heritage fund **** were rejected, so the full amount of these works was paid by the Local Federation of Madrid.

This period was also used to carry out interior renovations on the premises. Floors were laid, walls were plastered, bathrooms and all electrical and telephone installations were renovated, doors and windows were painted and varnished, and other work was done. Many of these tasks were completed thanks to the efforts of comrades from the Madrid Local Federation, but others, due to their scale and complexity, had to be contracted out. These works cost €46,442.65.
The combined costs for the two floors and the interior work totaled €145,025.97, which was paid by the Madrid Local Federation.
2017 – The Construction Union of the Local Federation of Madrid (with the deeds to the sixth floor were in its name) is dissolved due to lack of membership and merged into the Various Trades Union of Madrid. *****
(***** The deed was not transferred to sold to another union because the practice always was that all unions of the Federation used and paid for the space together and they could not predict the treacherous and fraudulent steps of their former comrades.)
2018 – The Local Federation of Madrid is expelled from the CNT CIT. In another chapter, we explain how this expulsion went against the organization's agreements and how it was achieved.
2019 – The CNT-CIT takes over the premises ****** through a notarized deed exchange. To do so, it uses bylaws formalized years earlier by the Metal Workers' Union on the second floor, in which the latter ceded the premises to the CNT national federation. This was done after strong pressure from the Permanent Secretariat, based on a 1996 agreement. ******** These bylaws had already been revoked in 2019, although, due to internal administrative problems, they could not be filed with the registry of union organizations.

(******* This agreement was to transfer property owned by local unions to the national federation. The idea was to be able to keep or dispose of property in the case of the dissolution of a local union however this has been used to take over some properties of still functioning CNT-AIT unions. This was taking advantage of the good faith of local unions who trusted that the CNT-AIT was run in a fair way. After changes in that organization and the advent of CIT, it wasn't.)
The strategy to obtain ownership of the premises on the sixth floor consisted of attempting to reactivate (trans. - by CIT) the union that had been listed on the property deeds since its purchase in 1988: the Construction Workers' Union. However, it was a falsely reactivated union, which had not been active either before or after the notarial registration—since, as explained above, it had been dissolved in 2017—and which never appeared on the CNT CIT union lists. Thus, all they had to do was renew the secretariat in the registry of union organizations, taking advantage of the fact that the FL had not deregistered the union when it dissolved in 2017.
October 2019 – CNT-CIT, using the deeds amended that same year, successfully forced the property's homeowners' association to stop accepting our payments. Starting in 2020, it also prevented us from continuing to pay the property tax. Until this date, the Local Federation of Madrid had covered all expenses associated with the property (community fees, major works, taxes, etc.). Naturally, utility costs (electricity, telephones, etc.) continue to be paid by the Madrid Local Federation to this day.
2020 – The CNT-AIT began repaying (trans. To CIT) the loan amounts granted to settle the mortgage. Before that, (two years after our disaffiliation), we had already paid €67,730.47, representing 63.93% of the total loan.
As we believe is quite clear in this chapter, the aim is to divest us of premises that the Madrid Local Federation has paid for and maintained since they began being rented out in the 1970s. As we pointed out in the negotiation proposal presented to the CNT-CIT, included as an annex to this chapter, the Tirso de Molina premises were not acquired with historical heritage funds, but rather through a mortgage loan assumed by the unions of the Local Federation. To settle this loan, the CNT subsequently granted us a loan, of which, as mentioned above, we have repaid more than 60%. ************ In addition to the money invested in paying off this debt, the unions of the Local Federation have assumed significant expenses on major projects and the maintenance of the premises over all these years, as they have been essential to the functioning of our unions.
(*********** Again, the original loan came from CNT-AIT, thus from the dues money of the membership. Later, the CIT assumed that this money was owed to it.)
Trying to take away what we have built with collective effort is nothing more than an unfair and disloyal maneuver that, at this point, is indefensible from any minimally critical perspective. The locals, for those who sustain them and keep them alive.

The agreement of 1996 they speak about must be the VIII congress of CNT and a subsecuence national plenary that toke more specific agreements. In this congress CNT toke agreements on how to use the money of patrimony and what happens if a union is expelled, leave or disappear:

Base on this agreement and the fact that CNT Madrid asked for money from patrimony, the premises should be register in the name of the confederation. The fact that some unions from the local federation tryed to don't comply with CNT agreements don't change this fact.
In resume, this text of FL Madrid IWA only prove that, by CNT agreements and also legally, the premises are from CNT.

The .historic patrimony was compensation for the loss of hundreds of union halls, print shops, etc which were all owned locally because the CNT-AIT were opposed to centralization.. That said, the .historic patrimony paid out by the Spanish government was directly paid to the CNT-AIT not each local who lost their union halls.

The supposed reason for not responding earlier is being „too busy” - an excuse which really seems dismissive rather than real. The CNT-AIT has written a response, which we publish here. It seems more likely that they are looking for a new alternative reason, hoping that their supporters are really just blind believers, who won't question what they say, or the fact that they have been explaining this differently for years. The fact is that the CIT organization filed dozens of lawsuits, which we have seen, a fact we have been denouncing since 2017. When the cases finally came to court, after the CNT-AIT had grown by numerous unions, they laid on more lawsuits.

For the record, I'm not in any IWA organization or agree with everything within the IWA and personalities. I do stand for solidarity with the IWA Principles. And opposed to the CITs revisionism. It's too bad that Spanish anarcho-syndicalism continues to devolve. My opinion only.

The CNT-AIT writes:
„In their statement, the CIT of Madrid recalls that the CNT-AIT separated from the IWA some time ago, but they don't explain how that process unfolded. The decision wasn't made at any Congress or Plenary session of the Organization. (trans.- CNT-AIT) Their statement mentions respecting agreements freely reached by majority vote or assembly, but the break with the IWA was driven by their refusal to respect the agreements of its 25th Congress (Valencia, December 6-8, 2013). That congress ratified the continuation of equal representation for sections, with one vote per country or section, rejecting the proposal to introduce a proportionality system, similar to a parliamentary one, where those who paid the most would have more votes. In addition to their refusal to respect that agreement, they also disregarded the congresses of the Spanish CNT section itself. These were the congresses held in Córdoba (trans.- 2010) and Zaragoza (trans. - 2015), which ratified their continued membership in the IWA, although the latter, in Zaragoza, stipulated that a proposal should be submitted to the IWA to modify its operating procedures. The proposal was never allowed to be implemented.”
This was because the Secretaries and Leaders of the organization at time actually decided to boycott the Congress in 2016 – a decision not made by the organization itself.
The CIT organization dishonestly claims that an „expulsion” of USI played part in their decision, but there was no expulsion of USI before the Spanish organization, so it could not be part of that organization's decision. The two organizations were disaffiliated on the same day. Rather, the facts are that three organizations were moving to form another international. This was evident before they were finally disaffiliated.
The 2016 Congress was attended by current members of the CNT-AIT as the CIT organization did not organize any organic meeting to go to the Congress which they intended to boycott. They only sent a person known for carrying out inquisitions in the Spanish organiztion to the Congress after they heard that members of CNT-AIT wanted to observe. The main motive was to see who was there, report them and move to expel them for maintaining contacts with the IWA. The „delegate”, sent by the National Committee, not elected by the membership, carried absolutely no mandate to the Congress.
The 2016 and 2017 Congresses recognized that those continuing in Spain were in fact that continuation of our Spanish Section, the CNT-AIT. We firmly reject any claims that our comrades cannot continue operating in the name they always had.
Part of the reason we recognize this as obvious (but the state, looking for more cooperative people may not) is that the Committees and Secretaries of the organization had broken many points of the CNT-AIT Statutes. The CIT union, with no shame, talk about infractions of other, many times made up. However, the CNT-AIT points out:
“Even before the aforementioned IWA congress, the Confederal Committee, by decision of its managers, had been withholding dues. When they failed to modify the equal representation system within the IWA, the amount withheld was increased to nearly 40,000. The objective could only have been to subjugate the International through this futile attempt at economic blackmail. However, the membership continued to pay the portion of the monthly dues that corresponded by agreement. We never knew exactly where the entire amount of the dues went.”
This is an important point. As an anarcho-syndicalist knows the organization mandates people like a Treasurer with different responsibilities and may impose different limitations on the Treasurer. The Statutes of the CNT-AIT clearly stated the responsibilities of the Treasurer and how the CNT-AIT's members dues were to be allocated. Among the things in the Statutes were allocated a fixed sum for the IWA, along with other things more should be spent on within the organization. This means that the Treasurer has to follow this mandate and do what the organization decided. He could not just make a decision by himself or with a small group of leaders to do something completely different with the money.
However, that is exactly what happened. Not once, but twice. The money was redirected: to where, people do not know to this day. One of the major issues was that the membership was not receiving financial reports for a few years and only found out later that their dues were not paid. As there was no Congress decision – or any organic decision for that matter – to do this, members demanded that the funds be used in accordance with their Statutes. But most of all, the CNT-AIT still had anarcho-syndicalists in it (at that point). And they demanded that the leadership act accordingly, not act as executive directors.
(It was shortly after revealed that the Secretary of the Organization had embezzled a lot of money and the Treasurer had been covering it up, so it turned out that some of the membership's money just went up his nose.)
Over the years it has been amazing to see people claiming to talk about anarcho-syndicalism who put up with this evident abuse of power in the organization. But that is what a group of people controlling most of the votes turned it into – because of both the passivity of the membership it recruited and its indifference to the actual operating principles of anarcho-syndicalism.
The CNT-AIT also briefly touches on how the CNT-AIT of Madrid was actually kicked out of the organization in breach of the operational statutes of the organization. (It was not the only organization to be purged in an anti-statutory manner.)
The IWA Secretariat, which is well aware of the history of the profound problem in the CIT organization and what actually went down, supports the decisions of the IWA to show solidarity with our Section in Spain, CNT-AIT, and denounce the vindictive legal cases brought against our comrades.
We point out that the CIT union maintains an authoritarian and monopolist mentality in relation to the name of the union. We have CNT-AIT in France, for historic reasons with the same acronyms. Many different re-alignments occured in that country: there is CNT-SO and just CNT; somehow they all manage. Even in Spain, there are numerous unions called CNT, some of which of not in CIT or AIT, but they were not sued. The union of CNT-AIT in Barcelona functioned outside of the federation for literally decades, but only got sued when they reafilliated to the IWA. 14 unions were disaffiliated in 1996, but all that time used the name CNT. They only became a „threat” to the CIT organization decades later, when they adhered to the CNT-AIT.
Simply put, we care more about our comrade's principles than what they call themselves, but anarcho-syndicalism has a legacy that many died for. It is shameful that an organization which has verticalized became a bastardization of this historic legacy. In fact, what they are doing is trying to gather all the capital, manage groups of workers who are not really committed to building horizontal, revolutionary organizations and trying to crush any other people to do not conform to the vision they have for their leadership.

On November 5th, the “LIBERTARIAN LABOR UNION FOR MUTUAL SUPPORT AFFILIATED WITH THE NATIONAL CONFEDERATION OF LABOR, CNT,” which signs as „CNT MADRID”, issued a statement referring to our organization and the ongoing conflict. This statement, riddled with inaccuracies and some falsehoods, compels us to respond. While some of what we will explain may already be known from other statements, it is necessary to reiterate it for a clear understanding of the current situation.
In their statement, the CIT of Madrid recalls that the CNT-AIT separated from the IWA some time ago, but they don't explain how that process unfolded. The decision wasn't made at any Congress or Plenary session of the Organization. (trans.- CNT-AIT) Their statement mentions respecting agreements freely reached by majority vote or assembly, but the break with the IWA was driven by their refusal to respect the agreements of its 25th Congress (Valencia, December 6-8, 2013). That congress ratified the continuation of equal representation for sections, with one vote per country or section, rejecting the proposal to introduce a proportionality system, similar to a parliamentary one, where those who paid the most would have more votes. In addition to their refusal to respect that agreement, they also disregarded the congresses of the Spanish CNT section itself. These were the congresses held in Córdoba (trans.- 2010) and Zaragoza (trans. - 2015), which ratified their continued membership in the IWA, although the latter, in Zaragoza, stipulated that a proposal should be submitted to the IWA to modify its operating procedures. The proposal was never allowed to be implemented.
Even before the aforementioned IWA congress, the Confederal Committee, by decision of its management, had been withholding dues. When they failed to modify the equal representation system within the IWA, the amount withheld increased to nearly 40,000. The objective could only have been to subjugate the International through this futile attempt at economic blackmail. Nevertheless, the membership continued to pay the portion of the monthly dues that was agreed upon. We never learned exactly where the entire amount of the dues went.
With this imposition by the leadership, violating the agreements of all the congresses, the IWA's requests for explanation regarding the non-payments that had persisted for years were met with a response. The response was simply to act as it should, by inviting expulsion. That was the intention, achieved through a fait accompli. But to further force their own disaffiliation, and while still part of the IWA, they organized a public meeting in Barakaldo calling for the creation of another international organization. (trans. note- Nov. 2016. Secretariat note: another meeting for this purpose had taken place in June 2016 in Italy). This is now known as the CIT.
It is evident that they were unable to bring down the IWA, which today maintains a presence in 22 countries and is expected to expand at the next congress. And, of course, its CNT-AIT section is present in the context we are discussing.
Since the Madrid CIT speaks of usurpations, it should be responding to the numerous requests from the IWA for the return of its archives, originally deposited at the Anselmo Lorenzo Foundation, now occupied by the CIT, but which they refuse to return to the IWA.
They are also lying when they claim ownership of the CNT-AIT premises in Madrid. Before the CIT falsified documents, one of the two floors was legally owned by the CNT-AIT Construction Union of Madrid, and the other by the Metalworkers' Union, also part of the CNT-AIT, not the CIT. All payments for expenses, renovations, maintenance, and loan repayments were made by the Local Federation, as stipulated in the purchase agreement. They falsified documents, just as the CIT of Olot did in Figueres (Catalonia), to convince a court that they were the CNT-AIT of Figueres and keep its premises. Thus, in Madrid, they registered the historic CNT-AIT premises in their name.
Furthermore, they accuse the CNT-AIT of filing lawsuits. They omit the fact that on December 31, 2017, their legal secretary announced that they had initiated legal action against the unions that were already part of the CNT-AIT at that time. Who started this? (See note 1).
In the specific case of Madrid, they try to portray it as a cross-complaint, attempting to equate their aggression with our defense. Are they trying to make people think that requesting an eviction is the same as trying to stop it? Will our comrades in Madrid be the violent ones when the police sent by the CIT arrive at the premises? Let's see how they cover that up.
In their complaints before the National Court, we stated that appealing a complaint is not using the legal route. Using the legal route means filing a lawsuit, as they have done against each and every one of the CNT-AIT unions, demanding €50,000 from each union—an amount they know no union has anywhere near—with the clear intention of legally shutting them down. And when the CIT filed a criminal complaint seeking two years in prison for CNT-AIT members in Tarragona for opposing the sale of their premises, were we also the ones using the legal route? And what does the CIT membership know about all this? Do they agree? Have they been consulted?
All these decisions to sue unions, seize their premises, carry out evictions, and even seek imprisonment are decisions made by the CIT leadership. Their unions and members find out about it online. That is the concept of horizontality and assembly-based decision-making held by the authoritarian leadership of that organization.
And in the same way, the CIT, with very little shame, accuses us of its own actions and speaks of assaults. No CNT-AIT union has assaulted a CIT union office, nor have we tried to sell them, nor have we demanded money from them, nor have we called for their imprisonment. The CIT, however, did assault, rob, and destroy everything it could on repeated occasions in Cádiz and recently in Figueres. They did the same in Madrid when they fraudulently expelled the Local Federation of Unions against agreements (note 2). Before reaching the agreement, they raided their offices in Plaza Tirso de Molina. These are the same offices for which they are now requesting a police eviction order, since today those premises in the center of Madrid are worth millions of euros.
It should be added that a member of the Valladolid branch of the CIT participated in the repugnant but ultimately unsuccessful attack on our Madrid premises. This same member, during his time on the Confederal Committee, was known to have covered up the theft of tens of thousands of euros from the Confederal Committee's funds. Subsequent administrations of the Confederal Committee followed suit, and discrepancies and a lack of transparency in the accounts persisted. The then-Secretary of the Central Regional branch also participated in the attack. He continued to serve in that capacity even though he was no longer a member of the CIT, as he was affiliated with the Madrid Local Federation, which had been fraudulently expelled. His actions consisted of closing the Madrid premises without authorization, invading the second-floor office, expelling the comrade who was permanently stationed there, and changing the locks. These are just a few examples of how the actions of the CIT's leadership are precisely the opposite of what they preach, demonstrating once again that those who should be keeping quiet are always the ones who talk the most, hiding their shameful actions amidst a torrent of lies.
In the coming months, the CIT will continue its legal attempts to have the police raid the CNT-AIT Madrid premises in Tirso de Molina, a social landmark for decades that has hosted countless activities and provided a space for so many grassroots groups. But the CIT has a problem with its top-down and opaque structure; its intention, already approved, is none other than to sell off as many premises as possible, even those occupied by active unions.
Anarcho-syndicalism cannot and must not sell the premises created by the work of our predecessors. Anarcho-syndicalism must breathe life into these premises. And it must relaunch those closed due to the burning of so many militants by all these maneuvers of power, falsification, and inconsistency with our principles.
Finally, the CNT-CIT Madrid statement claims that “Months ago we took the initiative to open a channel for dialogue… Tirso de Molina showed no hurry,” but the truth is that they said this after their Confederal Committee had already filed the eviction notice. Nothing more happened in the plenary session of their Confederal Committee prohibiting them from continuing the process. Clearly, the CNT-AIT, which has weathered far worse times in its long history, will stand up to them. A gang of thugs will not be able to do what the State, in all its forms, has never managed: extinguish anarcho-syndicalism.

Which AIT/IWA principle do you defend? Also what are those anarchist syndicalism revisionism stuff from CIT/ICL? Curious.
Facts:
1. Branches that are now the Spanish IWA section got expelled because bad behaviour and not respected CNT internal agreements.
2. Locals are buy from the Confederation, most of the time like those cases. Also the historical heritage from before the dictatorship were compensated to CNT, not the branches. The money from buy locals for the branches or selling locals when they get small or not need because there is no branch are only for that. They can not use it for other intentions.
3. If you get expelled you have to leave those locals that you were using as you are not longer CNT anymore.
4. If you get expelled, you can not call yourself the same name that the union you are getting expelled.
5. The use of violence and tribunal started from the expelled. (Those madrid-AIT/IWA assault Tirso the Molina CNT locals with an Axe and a Fire extinguisher, and attack those who were guarding the space.)

About the number of members of AIT-SE I made a calcul around 2018 and they were between 500 and 1000. Not easy to calculate because most of the unions were or not paying or paying a different quantity than the real one. Also after this calculation most of the AIT Granada members came back to CNT. A big majority of the union vote to came back, but because in AIT-SE the agreements must be taken by a 75% of the union, the result was that the majority leave AIT Granada and came back to CNT. Also, part of this people was thinking at the begining that they were in CNT. Only when they saw that in the national meetings were missing a lot of regionals, they realise that they were not in CNT.

Each of the organizations listed above, all have been splits from the historic CNT-AIT. Each representing one form of attempted "renovation" of the historic CNT-AIT, concerning union tactics, using state machinery, court cases and use of historic names and union halls etc etc.
All part of the devolution of the historic CNT-AIT these past almost 50 years.
And my observation of how those who went off to form the CIT acted within the IWA/AIT
certainly makes me want to continue to share the CNT-AIT's information. That said, I will continue to eagerly read with interest the non-IWA organizations press. And will express solidarity or share info when workers are in struggle.
As I have said many times over, those of who us who were young anarcho-syndicalists in the 1970s had so much reason to be hopeful when our Spanish comrades came out of the underground to begin the process of above ground reorganization. It has been a long and disappointing road since then. Yet the struggle continues until the end. Whatever that end might be.
