Cop watch link dump

Blog post for people to post links to stories about police brutality and violence. Trigger warning for police violence and sexual violence.

Submitted by Steven. on May 14, 2012

For a while I have thought it would be good for someone to have a blog on libcom dedicated to keeping track of police violence.

However, in the absence of anyone volunteering to do that I thought I could put up this blog post and then anyone can post links with short summaries in the comments below as a kind of repository of news of police brutality and abuse of their power.

Even though I have no faith in the police as an institution there to protect us in any way, I have been shocked by the sheer number and sheer outrageousness of police abuses recently that it has prompted me to actually post this up.

So, please post your links and summaries below, and if somebody wants to take on contributing this sort of thing to libcom on a running basis please let me know.

Radley Balko's 'The Rise of the Warrior Cop' is an interesting book about the miliatarisation of american police forces. Specifically the growth of SWAT teams and their use of military equipment largely to serve low risk drug warrants and the accompanying machismo that extends to their recruitment but is functionally useless as SWAT teams are actually pretty nervous about tackling people with guns rather than serving midnight no-knock warrants.

Woman who miscarried in private prison 'made to clean up after herself,' court told

http://www.independent.co.uk/news/uk/crime/woman-who-miscarried-in-private-prison-made-to-clean-up-after-herself-court-told-9002657.html

A woman who had a miscarriage at a private prison was left to clean up after herself while the foetus remained in her cell, it has been alleged.

Although a nurse was present when remand prisoner Nadine Wright, 37, lost her baby, she says the foetus was left with her afterwards and that she had to clean up the blood.

Her barrister, Philip Gibbs, told Leicester Crown Court: “There was blood everywhere and she was made to clean it up.

“The baby was not removed from the cell. It was quite appalling. It was very traumatic. She only received health care three days later, after the governor intervened.”

The incident allegedly took place the day after Wright was taken into custody at HMP Peterborough on 23 November. It was not revealed in court how many months pregnant she was.

Mr Gibbs told the court that Wright had landed in prison after she stole £13.94 worth of food out of desperate hunger as she did not have the money to pay for it because she had not been given benefit payments she was entitled to...

Unbelievably lenient sentence for cop who fingered suspects’ anuses

The end of 2013 brought a measure of closure to a long-running Milwaukee police scandal, though some say the officer — and his cohorts — who repeatedly and illegally shoved his fingers up black male suspects’ anal cavities got off with a light sentence considering the flagrant nature of his abuses.

The ringleader was identified as officer Michael Vagnini, a white man who routinely targeted black males as young as fifteen for sadistic — and blatantly illegal — anal searches.

One victim said that another officer put a gun to his head while Vagnini administered a choke hold, touched his scrotum and fingered his anus. Another man was probed so violently that he bled.

Wisconsin law clearly prohibits police officers from administering cavity searches. Only medical professionals may do so, and only when authorized by a warrant.

But lack of a warrant or a medical degree did not stop Vagnini from sticking his fingers inside a 15-year-old boy’s anus and touching his genitals during a traffic stop in December of 2011.

Not just a British or an American phenomenon, police murderers in Italy get their jobs back..

Aldrovandi killers to return to uniform

In Ferrara last week, on 22 January, a Department of Security disciplinary commission reinstated the four police officers responsible for the death of Federico Aldrovandi. Aldrovandi was a teenager when he was murdered on 25 September 2005 by being brutally beaten by the three men and a woman.

All four can now resume their old jobs because, thanks to various cover-ups which slowed the case down, they have not been dismissed from the police force.

Not strictly law enforcement but South African mine owners are purchasing paintball equipped drones for crowd control in strike situations.
http://www.theverge.com/2014/6/17/5819564/skunk-drone-shoots-crowds-with-pepper-spray-paintballs

I know paintball markers are not new in police arsenals, Israel, Turkey, parts of the US use them but as far as I know this is the first time they've been used in conjunction with drone technology, and generally they're not seen as a serious weapon, after all people use them to play with. However, the ones used by the police (and in this case private security) are not to be confused with the sporting equipment, they're calibrated at a much higher velocity which is permitted for playing and what they shoot are not paintballs, they have chemical irritants, sometimes they're weighted with bismuth, they use plastic pellets which can break glass. A few years back a woman died in Boston when she took a hit with a pepperball from the police in the eye.

There seems to me to be a proliferation of "non-lethal" police weaponry, which largely seems to go uncommented upon in the mainstream, of which this is just one example.

The New York Police Department has launched an internal investigation into the death of a 43-year-old man whose final moments were captured in a video in which he can be heard gasping “I can’t breathe” over and over again after an officer is seen placing him in a chokehold, officials said.

The man, Eric Garner, died on Thursday afternoon as plainclothes officers tried to take him into custody on a street on Staten Island on charges of selling cigarettes, according to an account the police have released. A video, posted on the website of The New York Daily News, shows an argument of mounting intensity as Mr. Garner quarrels with a plainclothes officer about whether he would be arrested or not.

A 400-pound asthmatic Staten Island dad died Thursday after a cop put him in a chokehold and other officers appeared to slam his head against the sidewalk, video of the incident shows.

“I can’t breathe! I can’t breathe!” Eric Garner, 43, repeatedly screamed after at least five NYPD officers took him down in front of a Tompkinsville beauty supply store when he balked at being handcuffed.

Within moments Garner, a married father of six children with two grandchildren, stopped struggling and appeared to be unconscious as police called paramedics to the scene..

On Monday night while, 1,800 miles away, Ferguson was rioting over the shooting of Michael Brown, Ezell Ford was walking down a street in Los Angeles.

It wasn’t the nicest street. Florence, where Ford was walking, has one of the highest rates of violence in Los Angeles County.

It’s not clear what Ford was doing. Ford had a history of mental illness and had been convicted of marijuana possession and illegal possession of a loaded firearm. In January, he was put on probation for trespassing in Long Beach. But there’s not yet information about what he was doing wrong, if anything. And it’s not yet clear why he was stopped by police.

What is clear: After he was stopped, Ford was killed, shot by two members of the Los Angeles Police Department.

Researchers: Police likely provoke protestors — not the other way around

New research from the University of California, Berkeley, shows that police are often the provocateurs of violence during demonstrations.

The Deciding Force project, who has been studying clashes between law enforcement and protestors in 192 cities during Occupy demonstrations in 2011, said that attacks by police against protesters in Ferguson, Mo., are part of a disturbing trend of law enforcement playing the role of agitator.

“Everything starts to turn bad when you see a police officer come out of an SUV and he’s carrying an AR-15,” said Nick Adams, a sociologist and fellow at UC Berkeley’s Institute for Data Science who has been heading the research at the Deciding Force Project. “It just upsets the crowd.”

From the moment Los Angeles police handcuffed him, Jorge Azucena told officers he needed help.

"I can't breathe, I can't breathe," he pleaded. "I have asthma, I have asthma."

In the half-hour or so after his arrest late one night last September, Azucena said over and over that he was struggling for breath. Numerous LAPD officers and sergeants heard his pleas for medical attention but ignored them even as his condition visibly worsened.

"You can breathe just fine," one sergeant told him. "You can talk, so you can breathe."

Azucena could not walk or stand by the time officers brought him to a South Los Angeles police station for booking. So they carried him into a cell, leaving him lying face-down on the floor. He was soon unconscious. When paramedics arrived shortly after, Azucena's heart had stopped.

The Los Angeles County District Attorney’s Office declined to press charges against a sheriff’s deputy who was apparently distracted by his mobile digital computer when he fatally struck cyclist Milton Olin Jr. in Calabasas in December, officials announced Wednesday.

...

“Wood entered the bicycle lane as a result of inattention caused by typing into his (Mobile Digital Computer),” according to the declination letter prepared by the Justice System Integrity Division of the District Attorney’s Office and released Wednesday. “He was responding to a deputy who was inquiring whether the fire investigation had been completed. Since Wood was acting within the course and scope of his duties when he began to type his response, under Vehicle Code section 23123.5, he acted lawfully.”

LAPD Confuses Black Actress Kissing White Husband for Prostitute

African-American actress Danièle Watts claims she was "handcuffed and detained" by police officers from the Studio City Police Department in Los Angeles on Thursday after allegedly being mistaken for a prostitute.

According to accounts by Watts and her husband Brian James Lucas, two police officers mistook the couple for a prostitute and client when they were seen showing affection in public. When the officers asked Watts to produce a photo ID when questioned, she refused. Watts was subsequently handcuffed and placed in the back of a police cruiser while the officers attempted to figure out who she was. The two officers released Watts shortly afterwards.

Several Los Angeles police officers are under investigation after being caught on camera beating and repeatedly body-slamming a woman during what was a routine traffic stop in Tujunga.

Surveillance footage of the incident was first obtained by local NBC LA. It shows the officers pushing her into a squad car, then giving congratulatory fist bumps to each other, celebrating their abuse of the woman.

there's been a great deal of this sort of thing too

Deputies shot and killed a man inside his Georgia home last month following an apparently bogus tip they received from a confessed meth addict and thief.

East Dublin resident David Hooks, 59, was killed because, according to Laurens County Sheriff Bill Harrell, he aggressively brandished a gun at the SWAT team that broke in his back door. But Mitchell Shook, a lawyer for Hooks' widow, contends that the sheriff has misled the public about the shooting and raid, which turned up no drugs.

notoriously,

A Georgia grand jury has opted not to charge any police who took part in a drug raid that disfigured a toddler.

Bounkham (Bou Bou) Phonesavanh, then a 19-month-old toddler, lost part of his nose and left nipple, and suffered burns to his face, brain injuries and a collapsed lung when a police stun grenade exploded in the playpen he was sleeping in May 28.

The Habersham SWAT team executed a no-knock warrant on the Cornelia, Ga., home where Phonesavanh's family was staying after their Wisconsin home burned down earlier in the year. Police were searching for a relative they believed was a drug dealer who had a cache of weapons inside, but the Habersham County Sheriff later admitted they had no knowledge of children at the home.

An elderly woman got the last word after locking a police officer in her basement, and later suing the police.

Venus Green, who was 87 when she was handcuffed, roughed up and injured by police, will receive $95,000 as part of a settlement with Baltimore City. The city chose to settle the case instead of taking a chance in front of a jury.

"We thought we would have a difficult time in front of a city jury, or any jury," Baltimore City solicitor George Nilson said.

Green was so put out by what police officers did, the city said she locked one of them in her basement.

Facing a rare police brutality rap, two NYPD cops are expected to be charged Wednesday for beating a Brooklyn teen with their fists and a gun, the Daily News has learned.

David Afanador and Tyrane Isaac are expected to surrender and answer an indictment for assault and official misconduct for the alleged caught-on-tape attack against 16-year-old Kahreem Tribble, according to multiple sources.

update

The surveillance video starts with a 16-year-old running down a sidewalk in Brooklyn, with the police in pursuit.

The teenager, Kaheem Tribble, then slowed and faced an officer, Tyrane Isaac, who took a wild swing at his head. As another officer, David Afanador, approached, Mr. Tribble raised his hands; Officer Afanador swung his gun at the teenager’s mouth, breaking his teeth, prosecutors said.

The episode on Aug. 29 has led to criminal charges against the two officers, who were arraigned on Wednesday.

Officer Afanador, 33, was charged with felony-level assault, along with criminal possession of a weapon and official misconduct. Officer Isaac, 36, was charged with misconduct and misdemeanor assault.

...

The officers, both dressed in dark suits, did not speak at the hearing on Wednesday. They were released without bail.

no indictment in garner death

http://www.nytimes.com/2014/12/04/nyregion/grand-jury-said-to-bring-no-charges-in-staten-island-chokehold-death-of-eric-garner.html?ref=nyregion

A Staten Island grand jury voted on Wednesday not to bring criminal charges in the death of Eric Garner, a black man who died after being placed in a chokehold by a white police officer.

The decision was reached after months of testimony, including from the officer who used the chokehold, Daniel Pantaleo. The grand jury reached its decision less than two weeks after a grand jury in Ferguson, Mo., declined to bring charges against a white officer who fatally shot an unarmed black teenager, Michael Brown.

An autopsy by the city’s medical examiner found that Mr. Garner’s death was a homicide resulting from the chokehold and the compression of his chest by police officers.

Tamir Rice, a 12 year old boy in Cleveland, has died of his injuries. He was shot twice in the stomach by police. He was carrying a Airsoft replica gun. (For those who are not familiar, they fire little, usually plastic, pellets.)

http://www.wfsb.com/story/27458055/update-12-year-old-shot-in-officer-involved-shooting-at-cleveland-rec-center

http://www.latimes.com/nation/nationnow/la-na-nn-cleveland-tamir-rice-timothy-loehmann-20141203-story.html

The rookie Cleveland police officer who fatally shot 12-year-old Tamir Rice last month had been deemed unfit for duty at a previous police department and was in the process of being fired when he resigned from his post, according to records released Wednesday.

Cleveland police have said Officer Timothy Loehmann, 26, shot Tamir as the boy held a toy gun at a recreation center on Nov. 22. Video released last week of the incident shows Loehmann and his partner, Frank Garmback, driving up within feet of Rice, then Loehmann shooting him at close-range seconds later.

...

According to Loehmann’s personnel records, released by the city of Independence, police officials were in the process of firing him when he resigned in December 2012. Supervisors described an emotionally unstable recruit with a “lack of maturity” and “inability to perform basic functions as instructed” during a weapons training exercise.

A Texas cop is under investigation after using a stun gun on an elderly man he had stopped for an inspection sticker issue that the officer himself apparently didn't understand.

Dashcam video from the incident posted by Raw Story, above, shows officer Nathanial Robinson, 23, pull over Pete Vasquez, 76, at Adam's Auto Mart in Victoria, Texas, as "Under Ground Kings" by Drake blares from the cruiser's radio.

Vasquez gets out of the car, walks behind it and gestures toward the license plate and to the office of the dealer, where he works. He later told the Victoria Advocate newspaper that he was explaining that the dealer tags on the car make it exempt from inspection.

Victoria Police Chief Jeffrey "J.J." Craig confirmed to the paper that the car was exempt.

On the video, however, Robinson appears to try to snatch a piece of paper from Vasquez without success. Then, he grabs Vasquez's arm, twists it behind him and pushes him against the hood of the cruiser. After a brief scuffle, the cop reaches for both of Vasquez's arms and drags him the ground, out of camera range.

When the cop is next seen in frame, he's yelling and holding up a stun gun.

A man emerges from the dealer's office and yells at the cop.

"I told the officer, 'What in the hell are you doing?' This gentleman is 76 years old," sales manager Larry Urich told the newspaper. "The cop told me to stand back, but I didn't shut up. I told him he was a goddamn Nazi Stormtrooper."

Chad Chadwick has something many citizens can only covet - a spotless record.

"These cops are out of control. They are ruining good people's lives. I am a good man. I have done everything I can to show that, as a father, as a citizen, as a worker," said Chadwick.

But on the night of September 27th, 2011 Chadwick's commitment to living within the law did him no good at all.

It started when a friend concerned for Chadwick's emotional well-being called Missouri City police to Chad's Sienna apartment where he'd been distraught, drinking and unknown to anyone, had gone to sleep in the bathtub.

A SWAT team was summoned.

"They told a judge I had hostages. They lied to a judge and told him I had hostages in my apartment and they needed to enter," said Chadwick.

Chadwick did own a single shotgun, but had threatened no one, not even himself. Chadwick's firearm possession apparently prompted SWAT to kick in his door, launch a stun grenade into the bathroom and storm in, according to Chadwick, without announcing their identity.

"While I had my hands up naked in the shower they shot me with a 40 millimeter non-lethal round," said Chadwick.

A second stun grenade soon followed.

"I turned away, the explosion went off, I opened my eyes the lights are out and here comes a shield with four or five guys behind it. They pinned me against the wall and proceeded to beat the crap out of me," said Chadwick.

That's when officers shot the unarmed Chadwick in the back of the head with a Taser at point blank range.

"They claimed I drew down with a shampoo bottle and a body wash bottle," said Chadwick.

And it wasn't over.

The New York Post is reporting two New York City police officers were shot while sitting in their police cruiser in the Bedford–Stuyvesant neighborhood in Brooklyn.

Authorities state that both officers, who were rushed to Woodhull Hospital, died from their injuries.

According to the Post, the officers were shot “execution style,” point-blank by a lone gunman who approached their car.

“I heard shooting, — four or five shots,” said witness Derrick McKie. ““It sounded like from a single gun.”

The suspected gunman reportedly fled to a nearby subway station where he was fatally shot.

A suspect has surrendered for questioning in an attack on an MTA worker — and he turns out to be an NYPD cop, police sources said Thursday.

The NYPD’s Internal Affairs Bureau is now investigating the incident in which the Metropolitan Transportation Authority worker, on-duty and in her uniform, was put in a bear hug, thrown to the floor and choked, the sources said.

The 28-year-old transit employee was on the southbound D train platform at the Tremont Ave. station in East Tremont when the man attacked her about 2:30 a.m. Dec. 23, officials said.

She was hospitalized with minor back and neck injuries, police said. The attacker was caught on surveillance video running from the station with a smirk on his face, according to police.

Prosecutors here said Monday that they would pursue murder charges against two police officers who were involved in the fatal shooting last year of a homeless man with a history of mental illness, a case that led to protests and a federal criminal investigation and that is likely to be among the first to rely on evidence obtained by a camera worn by an officer.

follow-up

This week, Bernalillo County (N.M.) District Attorney Kari Brandenburg charged two Albuquerque police officers with murder in the killing of homeless man James Boyd. The shooting was captured on video and widely covered in the national media. Brandenburg’s decision comes on the heels of the controversial non-indictments in the deaths of Michael Brown and Eric Garner, which sparked protests around the country. It didn’t take long for Albuquerque police and their supporters to react.

you can just guess.

02/02/15, Palm Beach: a sheriff involved in a number of previous appalling incidents detailed below has now told drivers to run over Black Lives Matter protesters:

Recently, an investigative reporter for local WPTV Channel 5, Katie Legrone, exposed the Sheriff’s involvement in a massive cover-up related to the killing of two African American deputies who had been deploying stop sticks. A Caucasian deputy driving over 106 mph ran into them, but in spite of the lead traffic homicide investigator determining that the deputy driving should be charged with vehicular manslaughter, Sheriff Bradshaw removed that investigator from the case and replaced him with one who would find the deputy innocent of any wrongdoing.

Sheriff Bradshaw also has been at the center of more than 40 discrimination lawsuits filed against him. One of these resulted in a payout of over $1 million. Another stated that he showed photos and bragged about an incident where a police canine ripped the testicles off an African American man. He was also found to have stolen weapons out of the police evidence locker, presumably to plant an illegal gun on a suspect at a later date.

A grand jury has criminally charged two Philadelphia police officers with knocking a man from his motor scooter, beating him and then falsely accusing him of assault, in the latest case of alleged police misconduct in the United States.

Officers Sean McKnight, 30, and Kevin Robinson, 26, were charged with aggravated assault and related offenses in the May 2013 incident which occurred after a traffic stop in a gritty section of north Philadelphia, said Philadelphia District Attorney Seth Williams.

The victim, Najee Rivera, said he fled in fear on his scooter after officers exited their vehicle with their batons extended. That, according to Williams, enraged the pursuing officers.

One of them hit Rivera in the head with a baton as their patrol car knocked him off his scooter, prosecutors said.Rivera was hospitalized with a fractured orbital bone and numerous lacerations to the head. But McKnight and Robinson filed paperwork claiming Rivera attacked them.

Rivera's girlfriend, however, had canvassed the area of the beating, and turned up surveillance video of the beating.

"The video undermined every aspect of the officers' account," Williams told reporters at a news conference on Thursday. "None of it was true except for the blows inflicted on Najee Rivera."

The FBI is investigating an incident in which an Indian grandfather’s encounter with police in Alabama left the man partially paralyzed. An officer involved in the incident is under arrest, and the police chief proposed that he be fired, police said Thursday.

A spokesman for the FBI said that the agency became involved shortly after the Feb. 6 incident, and it is being treated as a civil rights investigation. The findings will be turned over to the Justice Department for review.

Sureshbhai Patel had recently come to the United States from his farm in India to help care for his grandson, who was born prematurely and was suffering from health complications.

At about 9 a.m. on Friday in Madison, Ala., just days into his visit, Patel was strolling through his family’s neighborhood when he was approached by police. A neighbor had called authorities and told them a man who looked “suspicious” was peering into garages, according to the Huntsville Times. That man, police determined, was Patel.

Within minutes, the 57-year-old grandfather was face down on the ground with a severe neck injury that left him partially paralyzed.

Police Beating Led To Miscarriage: Lawsuit

Cops beat a Georgia woman so badly that she suffered a miscarriage, according to a new lawsuit.

The suit, filed by Kenya Harris, names the City of Albany, Georgia, police chief John Proctor and officers Ryan Jenkins and Richard Brown, Jr., according to Courthouse News.

The suit claims that in May, 2011, Harris came to the Albany Police department after her son was arrested. She waited five hours to pick him up, but then told Jenkins she needed to leave to tend to her other children at home.

Jenkins said if she made that request again he would take her head and "'put it to the floor."

When Harris asked again, the suit alleges "Defendant Officer Jenkins, without provocation, grabbed plaintiff, who weighs less than one hundred twenty (120) pounds, by her neck and slammed her to the ground. Plaintiff momentarily blacked out and came to with defendant Officer Jenkins sitting on her back, and with his knee on her arm. Plaintiff was pregnant at the time."

Jenkins then arrested Harris for obstruction of justice, according to WFXL.

The next day when she was released from jail, Harris went to Phoebe Convenient Care for medical treatment and was told she had miscarried because of her injuries, the suit said.

Albany city attorneys declined to comment and the police department said neither officer named in the suit currently works for the department, according to WFXL.

The suit says Harris was the victim of excessive force and asks for $50,000 in punitive damages, according to the Atlanta Journal Constitution.

Two police officers have just been indicted on charges of conspiracy and misconduct. But until a dashboard video was released, the man who they victimized was actually the one in trouble.

...

The video shows Jeters with his hands clearly above his head.

“The next thing I know, one of them busts the door and there is glass all over my face,” Jeters told local WABC-TV.

“As soon as they opened the door, one officer reached in and punched me in my face. As he’s trying to take off my seat belt, I’m thinking, ‘Something is going to go wrong.'”

The cops kept telling him to “stop resisting” and claimed that he was “going for” their guns. Nothing could have been further from the truth.

...

Jeters subsequently had all of his charges dropped, and both cops were arraigned on charges of conspiracy, official misconduct, tampering with public records and false swearing, according to Essex County prosecutors. Officer Trinidad also faces an aggravated assault charge on top of everything else.

It is easy to forget that the real-life implications of false arrests go beyond just time served behind bars. An excellent story by Mike Newall, of the Philly Inquirer, really drives home the fact that the aftereffects of these cases are much more far-reaching than most people realize.

...

Rivera was riding his scooter when he spotted a police cruiser. The officers waived him on, but a moment later they began to follow him with their lights on. Panicked, Rivera sped away until the officers caught up with him. They reportedly slammed their cruiser into his scooter. Surveillance footage then captured officers Sean McKnight and Kevin Robinson throwing the young man against a wall, then onto the ground. They then began to beat him brutally with batons.

The officers later claimed that Rivera attacked them, but their claim was proven to be false and the two were fired, and charged with aggravated assault. Justice had seemingly been served, except that the incident might have cost Rivera the job he worked hard to get.

...

On the last day of his probation, his boss handed him a termination letter that offered no explanation whatsoever. Rivera was shocked — his supervisors had been praising his work and his boss even complimented him right before terminating him. He later found out from an HR rep that he’d been let go because of the three days he took off. A union rep said that there had been no other incidents besides the beating on his record. “The only thing was the police beating,” the rep said.

A white police officer in North Charleston, S.C., was charged with murder on Tuesday after a video surfaced showing him shooting in the back and killing an apparently unarmed black man while the man ran away.

The officer, Michael T. Slager, 33, said he had feared for his life because the man had taken his stun gun in a scuffle after a traffic stop on Saturday. A video, however, shows the officer firing eight times as the man, Walter L. Scott, 50, fled. The North Charleston mayor announced the state charges at a news conference Tuesday evening.

yeah, this is outrageous. Thankfully somebody filmed it. The cop just shot the guy multiple times in the back as he was running away.

Although if it hadn't been for Mike Brown and the riots, I'm sure that cop would have got off scot-free as well (of course, he may still get acquitted, but at least he will have to stand trial)

this is a follow-up

At 2 am on May 28, 2014, Bou Bou and his three older siblings were asleep when a team of militarized Habersham SWAT officers -- conducting a "no-knock" raid of the family home -- broke down the door and blindly threw a stun grenade into the room. The grenade landed in Bou Bou's playpen and exploded just inches from the toddler's face. Bou Bou immediately started screaming from the injuries of the devastating explosion: the grenade detached Bou Bou's nose, permanently disfiguring him, and create a gash in his chest that collapsed his left lung and prevented the infant from breathing on his own.
...
As for Bou Bou Phonesavanh? In February of this year, the Phonesavanh family filed a lawsuit on behalf of their son Bou Bou, against the Sheriff's office accusing police of wrongdoing when they obtained and executed their May 28, 2014 search warrant leading to Bou Bou's injuries. At the end of March, the Sheriff's office filed their reply to the complaint.

In it, they blame Bou Bou Phonesavanh's injuries on his own "criminal conduct".
...
In it, they also blame Bou Bou Phonesavanh's injuries on "failure to exercise ordinary care".
...
Finally, they blame Bou Bou for "failure to avoid consequences" in the attack.

Minutes later, two St. Johns County Sheriff’s deputies, 26-year-old Jonas Carballosa and 32-year-old Kyle Braig, arrived at the home, armed with assault rifles, and told Kaitlyn to wait outside.

“I thought they were going into war,” she remembered thinking when she first saw the large guns. Within moments, Justin was shot dead.

Denise Way, Justin’s mom, said the detective relayed to her that “they told Justin to drop the knife and he didn’t—so they shot him because ‘That’s what we do.’”

it never ends

After Florida police shot Jermaine McBean to death as he walked home with an unloaded air rifle, they said there was no reason to believe he did not hear their orders to drop the weapon and that he pointed it at them.

But a newly emerged photo that shows headphones in McBean's ears immediately after the 2013 shooting raises questions about the police version of events, including why the white earbuds were later found stuffed in the dead computer expert's pocket.

And another aspect of the police account is also being contradicted — by a man who called 911 in alarm when he saw McBean walking around with the air rifle but who also says McBean never pointed it at police or anyone else.

5 June 2015, Salinas, California: this video was posted to YouTube that shows a group of five officers with the Salinas Police Department violently hitting a man they have pinned to the ground during an arrest on North Main Street. Even though the man is on the ground and not moving, officers can still be seen hitting him with clubs. A YouTube user by the name of Richard Boxing uploaded the video with the title, "Salinas Police Wrong."

In a press release dated June 6, the Salinas Police Department released the name of the man who was arrested as being Jose Velasco, age 28. The press release also states that Velasco was tased by the officers.

Police say they were dispatched to North Main Street for a male who was, "screaming, running into traffic and jumping on cars," and that he was "reported" to be, "trying to throw a woman (who turned out to be his mother) into traffic in front of cars," according to the press release. The police give conflicting information in the press release, and also say that, "the victim had also called in about her son running in traffic."

The press release can be viewed at:
http://www.salinaspd.com/content/assault-deadly-weapon-assault-officer-causing-injury-resisting-arrest
_________________________________________________________________________
In the comments section of the YouTube video, Antoinette Ramirez, who says she is Velasco's sister writes:

"The cop who came in running just to hit him in the head. Had to do that. He was already on the floor. And yes he is sick. And why was he in the streets my mom had him their. So don't talk before you know the story you might have seen it. But you don't know the hole story. You don't known mom or my brother.
In danger to the cops come on they have guns. They know how to use them sticks. As you can see.
I didn't see my brother reaching for any of them cops. But okay.
Good job salinas PD
Ya okay."

"My Poor Brother. He is mentally ill and the cops had no right to keep hitting him he was already on the floor. The cops have done this to many times. I se the cops in the ER walking around like they got hurt. Bull shit. He didn't hurt any of them cops. And to do that in front of my mom is so harsh. Praying for everyone in salinas. The cops are out of control. And they can be who's going to stop them :("

"He didn't try to kill my mom. You guys don't know shit. You dum ass fuck heads. She walked away just fine. You all talk but don't know nothing. The day it's someone close to you. I'm sure you'll be crying to. But till then good job cops right. It's always good job to the cops. Even when they kill this young men. Stupid ass ppl you don't know shit."

"No he did not try to hurt or kill my mom. Everyone can say what they want but only God knows the truth."

update:

An undercover New York police detective who joined a gang of motorcyclists as they attacked a driver and his family in Upper Manhattan was sentenced to two years in jail on Wednesday.

...

The attack was captured on video by other bikers, who posted the footage online. The graphic images were widely viewed, outraging many New Yorkers and giving the police enough information to track down the assailants.

Mr. Braszczok was convicted in June of assault, riot and other charges in connection with the attack during a three-week bench trial before Justice Wiley. He testified that he had never intended to hurt Mr. Lien, but fled after he saw other motorcyclists drag the driver from the S.U.V. and pummel him.

A federal jury Friday awarded a blind man $400,000 in a civil suit filed after his head was slammed into a counter by a Denver police officer.

Philip White of Eagle sued Denver police Officer Kyllion Chafin and another officer over a May 22, 2012, incident at the downtown Greyhound Bus Terminal.

...

White asked Chafin whether he could "touch" his badge, a blind man's way of verifying that Chafin was indeed a police officer.

Chafin declined.

Instead, he wrenched White's arms behind his back and pushed him forward, slamming White's head into a ticket counter, according to court documents.

Bleeding from the head, White was handcuffed and taken to the Denver jail. He was released about eight hours later, near midnight. No criminal charge was filed against White.

ps, he was 77 when this was done to him.

beat me to it John!
(surely the same article)

In a yearlong investigation of sexual misconduct by U.S. law enforcement, The Associated Press uncovered about 1,000 officers who lost their badges in a six-year period for rape, sodomy and other sexual assault; sex crimes that included possession of child pornography; or sexual misconduct such as propositioning citizens or having consensual but prohibited on-duty intercourse.

The number is unquestionably an undercount because it represents only those officers whose licenses to work in law enforcement were revoked, and not all states take such action. California and New York — with several of the nation's largest law enforcement agencies — offered no records because they have no statewide system to decertify officers for misconduct. And even among states that provided records, some reported no officers removed for sexual misdeeds even though cases were identified via news stories or court records.

Reminiscent of Rodney King in L.A., on November 12, 2015 Alameda County Sheriffs chased Stanislav Petrov across the San Francisco-Oakland Bay Bridge from San Leandro and then beat him to a pulp in an alley in San Francisco's Mission District. So bad, that even after reconstructive surgery -- including inserting metal rods -- he might not regain the use of one arm and will permanently be unable to move his fingers.

Thankfully, the good liberals (and I do say that sincerely) in the San Francisco Public Defenders office released this video:

From the local public news station's website:
Victim of Alameda Deputies’ Beating Still Hospitalized

A man beaten and arrested by Alameda County sheriff’s deputies in San Francisco early Thursday remains hospitalized and in custody of that department, a sheriff’s spokesman says, correcting reports that Stanislav Petrov had been released from San Francisco General Hospital and was jailed in the East Bay.

Olga Petrova, who says she is Petrov’s mother, contacted KQED Saturday trying to locate her son.

“I could picture him being in a coma or brain-dead or fully physically disabled for the rest of his life,” she wrote in an email. “After they methodically beat him on his head, I am really terrified to learn about his current state.”

Alameda County Public Defender Brendon Woods said after visiting Petrov at San Francisco General on Sunday that he suffered multiple lacerations to the back of his head but was alert and talking. Woods said both of Petrov’s arms were “crushed” in the beating. ‘I was shocked, outraged and disgusted. … I counted over 30 baton strikes. I’m not sure what facts would justify that sort of brutal beating.’ Brendon Woods, Alameda County Public Defender

“From his elbow through his hands are swollen,” Woods said. “It looks like he has several broken bones in both of his hands or arm areas.”

[...]

“I don’t plan on letting this go at all,” he said. “I think it’s just disgusting. The guy is clearly about to give up. … You hear smack, smack, smack. He’s yelling ‘Stop!’ It’s just terrible.”

Reached by phone Saturday, Olga Petrova said the incident had shaken her trust in law enforcement.

“It’s gone,” she said. “Those people, I want them. I want to have a lawsuit. I want them to pay not from American taxpayers. I want them to pay from their pension funds. I want them to pay for how they tried to kill him and what they have done to me.”

Petrova said she emigrated with her son, who she calls “Stas,” from Ukraine to San Francisco 18 years ago. She said her son, now 29, has led a difficult life — diagnosed with multiple mental disorders, including post-traumatic stress disorder and depression. She said he had suffered several concussions in the past.

“He was diagnosed in his early childhood,” she said. “He was born a blue baby and he was fighting for his development.”

Petrova said Petrov was prescribed Ritalin as a child, which she believes led him to use methamphetamines as an adult.

“He is my life,” Petrova said. “When we have poor, misfortunate, sick kids, we probably feel more compassion.”

Her recent contact with her son has been intermittent, she said, and the last time she saw him was about two months ago after she’d been searching for a while.

“I kissed him promptly and I asked him, ‘Stas, please be careful, I don’t know what is going on with you. Please be careful, I am exhausted, I can’t stand these sleepless nights,’ ” she said.

Petrova said her son is often “unpredictable,” and he struggles with finishing complicated tasks. She again lost touch with him and was shocked when she saw him being tackled and beaten on television.

“People who know him tell me, ‘He loves you to death,’ ” Petrova said. “It’s a very painful kind of love.”
The Alabama Justice Project has obtained documents that reveal a Dothan Police Department’s Internal Affairs investigation was covered up by the district attorney. A group of up to a dozen police officers on a specialized narcotics team were found to have planted drugs and weapons on young black men for years. They were supervised at the time by Lt. Steve Parrish, current Dothan Police Chief, and Sgt. Andy Hughes, current Asst. Director of Homeland Security for the State of Alabama. All of the officers reportedly were members of a Neoconfederate organization that the Southern Poverty Law Center labels “racial extremists.” The group has advocated for blacks to return to Africa, published that the civil rights movement is really a Jewish conspiracy, and that blacks have lower IQ’s . Both Parrish and Hughes held leadership positions in the group and are pictured above holding a confederate battle flag at one of the club’s secret meetings.

The documents shared reveal that the internal affairs investigation was covered up to protect the aforementioned officers’ law enforcement careers and keep them from being criminally prosecuted.

A police officer who held a gun to a man’s head, apparently to impress his friends, was convicted Wednesday of first-degree assault and misconduct in office.

After Officer Jenchesky Santiago’s conviction, the Prince George’s County police chief condemned the officer’s actions and said he was recommending that the department fire him.

The police department also released a cellphone video of the May 2014 incident, which showed Santiago holding the gun close to the man’s forehead and shouting, “I dare you to [expletive] fight me, son.”

http://www.workers.org/articles/2014/01/10/new-investigation-reparations-sought-clarence-moses-el/

In November 1996, Clarence Moses-El, who is imprisoned at Kit Carson Correctional Facility in Burlington, Colo., expected to be vindicated of the rape for which he had been convicted in Denver. Ever since his conviction in 1987, Moses-El has upheld his innocence. From the beginning, he asked that the biological evidence be tested. It wasn’t.

But in 1996, after having raised the $1,000 requested by Barry Scheck of the Innocence Project, money that he was able to pull together from donations given to him by fellow prisoners, Moses-El felt that he was finally going to prove his innocence.

He won a court order to get evidence tested, including a sexual assault kit, bed sheets and clothes of the victim. Four weeks passed. Instead of being tested, the evidence — in a box marked, “DO NOT DESTROY” — was tossed into a dumpster by the Denver Police Department. And with it, it appeared that Moses-El’s chance to prove his innocence was discarded.

Moses-El would later appeal his conviction, but the request for a new trial was turned down by a judge based on the 1988 Arizona v. Youngblood decision, which determined that destroying evidence or negligence, in and of itself, does not constitute “bad faith.” The court’s opinion stated, “Unless a criminal defendant can show bad faith on the part of the police, failure to preserve potentially useful evidence does not constitute a denial of due process of law.” (coloradoindependent.com, Dec. 2, 2013)

The destruction of the evidence was against procedures of the DPD, according to a series of articles on destruction of evidence published by the Denver Post in July 2007. The newspaper found at least 141 cases of persons in prison who had evidence thrown out that would have exonerated them of the crimes of which they had been convicted.

In 2007, attorneys associated with the Innocence Project requested that the case be reopened, especially after the Denver Post articles, but the district attorney, Mitch Morrissey, refused to investigate the case, stating, “The defendant has had his day in court.”

Investigator: ‘I have always had doubts’

Morrissey still upholds that Moses-El does not deserve a new day in court, despite a confession by the person originally identified as being the attacker.

LC Jackson, who was one of three people with the victim when they were drinking that night and identified as one of the persons possibly responsible for the attack, recently gave a confession after having written a letter to Moses-El, which began with: “I really don’t know what to say to you. But let’s start by bringing what was done in the dark into the light. I have a lot on my heart.” (Colorado Independent, Dec. 2, 2013)

Jackson is currently in prison for the 1992 rape and assault of a 9-year-old and her mother.

The victim did not bring up Moses-El’s name until almost two days after the assault, when she said a vision came to her in a dream. She claimed she had visions or premonitions before that had turned out to be true. Her first statement referring to who could be responsible for the brutal rape and assault, which led to her losing vision in one eye, was “LC, Earl, Darnell,” the three men she had been drinking with together earlier in the evening and before she went home alone.

Moses-El was arrested, while Jackson and the others were never arrested or questioned regarding the assault, although they were listed in the victim’s statement and police records.

As to why the victim would accuse Moses-El, the original investigator cites an ongoing argument between the victim and Moses-El’s spouse, the last of which ended with the victim telling his spouse that she would get even with her.

James Huff, a detective who investigated the case and is since deceased, stated in 2005 in a sworn statement: “Due to the fighting and the bickering, the jealousy, the pettiness, all of that, I always have had doubts about this. I could never prove it either way,” and “This is one of those cases where I really wish there was DNA.” (Denver Post, July 22, 2007)

There is now a resurgence to win a new investigation in the case and exonerate Clarence Moses-El. It is important that he be set free as well as paid reparations for the 27 years that he has been locked in prison for a crime he did not commit. This could have been proven years ago except for destroyed evidence and failure to test the evidence in the original trial.

Police Detective David Edward Abbott, a member of the Northern Virginia-Washington D.C. Internet Crimes Against Children Task Force, committed suicide Tuesday before law enforcement could arrest him on suspicion of sexually abusing minors.

Abbott, you will recall, was the detective in the noteworthy teen sexting case from July 2014, in which the authorities sought a warrant to take the 17-year-old male suspect to the hospital, inject him with a drug that would give him an erection, photograph his genitals, and compare the photo with existing pictures of his genitals the police had confiscated from his 15-year-old girlfriend’s phone.

The teen was eventually sentenced to one year of probation. Here’s the kicker: Abbott sued the teen’s lawyer for defamation. The lawyer, Jessica Foster, remarked to the media that the warrant to take pornographic pictures of her client—to be used as evidence that he was guilty of creating child pornography—was “crazy.”

...

Authorities now believe Abbott was a pedophile. He had inappropriate contact with two young boys, ages 11 and 13, according to patch.com. Police attempted to arrest him at his home earlier today, but he refused to surrender and eventually shot himself.

Another Metropolitan Police infiltrator exposed:

A woman who accepted a marriage proposal from a married undercover police officer has begun legal action against the Metropolitan police, alleging that she suffered “abusive, cold-hearted, psychological torture” from his deception.

The woman, known only as Andrea, had a two-year relationship with the officer, during which time the spy told her that he wanted a baby with her but did not tell her that he already had a wife and child and was an undercover cop.

DECATUR, Ga. — A white police officer was indicted here Thursday on six counts, including felony murder, in the fatal shooting last year of an unarmed black man who was naked and described as acting in an erratic manner.

The indictment of Officer Robert Olsen of the DeKalb County Police Department came about two weeks after the district attorney said he would ask a grand jury to pursue criminal charges in the death of Anthony Hill, a 27-year-old Air Force veteran.

The indictment, which District Attorney Robert D. James Jr. of DeKalb County announced at a Thursday night news conference, with Mr. Hill’s family members seated in the first row, was an emotional and surprising development. It played out in this city just east of Atlanta where, it seemed, few people had expected that Officer Olsen would be charged with murder. Mr. James said a judge had issued an arrest warrant and that Officer Olsen would soon be arrested.

“This is a day in history,” said a lawyer for Mr. Hill’s family, Christopher M. Chestnut, who also said, “Hopefully, this will set a precedent for discouraging paramilitary policing.”

A former Oklahoma City cop convicted of raping and sexually assaulting black women he preyed on while on patrol was sentenced Thursday to 263 years in prison during an emotional hearing.

Daniel Holtzclaw received the maximum sentence on 18 counts of raping and sexually abusing at least eight African-American women in 2013 and 2014.

...

Holtzclaw, 29, looked on with visible anger and attempted to make eye contact with the women, according to a KOCO reporter.

Holtzclaw’s attorney, Scott Adams, petitioned for a new trial before the sentencing based on claims that DNA evidence had been omitted from the investigation.

But the judge denied the motion on grounds that there was not enough evidence.

Five former New Orleans police officers pleaded guilty Wednesday to charges that stem from the shooting of six unarmed people — two of whom died — in the days after Hurricane Katrina in 2005.

These officers were sentenced to terms of between three and 12 years in prison, far less than they faced after being convicted at an earlier trial that was scuttled after what a federal court later described as “shocking breaches of prosecutorial ethics.”

...

Even before a retrial was ordered, the case offered a relative rarity: It is unusual for police officers to be charged for shootings — and even more rare for them to be convicted. A Washington Post investigation last year found that out of the thousands of police officers who fatally shot people over a decade, only dozens of them wound up facing charges stemming from these shootings.

this was the police too

Municipal police officers encircled the bus, detonated tear gas, punctured the tires and forced the college students who were on board to get off.

“We’re going to kill all of you,” the officers warned, according to the bus driver. A policeman approached the driver and pointed a pistol at his chest. “You, too,” the officer said.

With a military intelligence official looking on and state and federal police officers in the immediate vicinity, witnesses said, the students were put into police vehicles and taken away. They have not been seen since.
